We at Electro-Voice Dynacord LLC (together with our affiliated entities hereinafter “Electro-Voice Dynacord”, “we”, “our” or “us”) have outlined below some key highlights from the Electro-Voice Privacy Notice, in the event that we process information (hereinafter referred to as “data”) of users of the Electro-Voice website, mobile applications and its affiliated services (hereinafter referred to as “online offers”). We collect various types of data about our users in connection with the services or products, including:

The data we collect includes technical usage data, such as identifiers, IP address inferred geolocation data, internet or other similar network activity. We do not collect sensitive data; therefore, we do not offer a specific right to limit. The section titled “Collection of Data” contains more information on these categories.

  • For the U.S., this data may be used for analytic purposes.

We will not collect or use data for materially different, unrelated or incompatible purposes without providing you notice (or obtaining your consent, where required by applicable laws in the relevant jurisdiction). Additionally, we only retain data for as long as necessary to carry out the purposes for which we originally collected it and for other legitimate business purposes, including to meet our legal, regulatory, or other compliance obligations.

We may disclose your information with: 

  • Electro-Voice Dynacord LLC affiliated entities, 

  • service providers, vendors, consultants, suppliers, licensors, partners and other partners and entities performing work on our behalf, 

  • relevant authorities in accordance with, and as we deem required, necessary and/or appropriate by, or in connection with, applicable law, regulation, court order or legal process; 

We do not sell data for monetary consideration. We may transfer your data to states, provinces, or countries other than where you reside, including to affiliates and service providers. Therefore, your information may be accessible to courts, law enforcement and national authorities in such other jurisdictions. You can obtain information about our policies and practices with respect to foreign service providers, or ask questions about the collection, use, disclosure or storage of data by such service providers, by contacting our Data Protection Officer as described in the Privacy Notice. 

  • Our security measures are being continuously improved in accordance with the state of technological developments, however, absolute protection is not possible. We cannot guarantee the security of information posted or transmitted using the online offers.

The protection of your privacy is an important concern to which we pay special attention. We process data collected during your use of our online offers in compliance with this Privacy Notice and all applicable laws and regulations. IV. Sources of Data 

We collect data from the following categories of sources: 

  1. Directly from You. For example, when given by you or collected from you through your access to and/or use of our online offers, such as the use of our contact form. 

  1. Indirectly from You. For example, from observing your use of our online offers, or services related thereto. The following data may be collected automatically: device data (e.g. hardware model, operating system and version), and other relevant details and/or information. If the visit of our website is a result of online advertising such as banners, video ads, search engine advertising, etc., we or our agents, representatives, suppliers, vendors or consultants may record which banner, adware, etc. motivated or assisted with the use of our website. 

We will not collect additional categories of data or use the data we collected for materially different, unrelated or incompatible purposes without providing you notice or obtaining your consent, where required by applicable laws in the relevant jurisdiction. 


V. Disclosure & Sharing of Data  

We may use, store, compile, manipulate, share and disclose your data with third parties for the purposes stated above. Your data is disclosed with the following: 

  • Our affiliated entities to leverage shared services and improve our services; 

  • Our service providers, vendors, consultants, suppliers, licensors, marketing, partners and other partners and entities performing work on our behalf, such as hosting vendors, data analytics companies, 

  • Relevant authorities in accordance with, and as we deem required, necessary and/or appropriate by, or in connection with, applicable law, regulation, court order or legal process; 

  • Successor legal entities in case we conduct a merger or sale of assets; 

By accessing and/or using our online offers, you consent to the above uses and disclosure of your data in accordance with this notice.

VI. Newsletter 

Within the scope of our online offers, you can sign up for newsletters. We provide the so-called double opt-in option which means that we will only send you a newsletter via e-mail after you have explicitly confirmed the activation of the newsletter service to us by clicking on the link in a notification. In case you wish to no longer receive newsletters, you can terminate the subscription at any time by withdrawing your consent. You can withdraw your consent to e-mail newsletters by clicking on the link which is included in the respective newsletter e-mail. Alternatively, please contact us via the contact details provided in the Section “Introduction & Controller”. If you reside in the EEA, please note that signing up for newsletters might include the transfer of your data to recipients outside of the EEA where there is no adequate level of data protection pursuant to the GDPR.

VII. Use of Third-Party Application Analytics Tools 

Our mobile applications and its affiliated services use application analytics or monitoring tools, such as the Mixpanel application analytics tool, to provide us with an analysis of your use of our mobile application and its affiliated services. Mixpanel uses personal identifiers stored in the local memory of your device that enable an analysis of your use of our mobile applications and its affiliated services. The information generated by the personal identifier about your use of our mobile applications and its affiliated services (such as when you use our mobile applications and its affiliated services, details on the configuration of our mobile applications and its affiliated services or your operating system) is generally transmitted to, and stored on, a server of Mixpanel located in the U.S.A.  

Our mobile applications and its affiliated services use functional, analytic, and similar techniques, also from Mixpanel, to analyze and improve our mobile applications and its affiliated services. We use any anonymous information gathered by such analytics tools to analyze your use of our mobile applications and its affiliated services, to generate reports on the use of our mobile applications and its affiliated services activities and to perform other related services to you. Only authorized persons have access to this anonymized data. 


VIII. International Data Transfer. 

We may transfer your data to any other Electro-Voice Dynacord LLC affiliates throughout the world, when processing, storing, analyzing, and otherwise using data. We may also transfer your data to a service, provider, contractor, or third party outside the country of origin. Accordingly, your data may be accessible to courts, law enforcement and national authorities in countries other than the country in which you reside. You can obtain information about our policies and practices with respect to foreign service providers (including affiliates), or ask questions about the collection, use, disclosure or storage of data by such service providers, by contacting our Data Protection Officer or Electro-Voice Dynacord LLC as described below. 


IX. Children’s Privacy. 

We do not knowingly collect or use any data from online visitors under the age of 16. We do not knowingly allow visitors under the age of 16 to participate in any promotions or contests made available on our online offers from time to time. 


X. Use of Links to Affiliated Sites 

Our online offers may contain links to other Electro-Voice Dynacord LLC sites, products or services. Our online offers provide these links only as a convenience. Your use of these Affiliated Sites and any related services are outside the scope of this Privacy Notice and is governed by the Privacy Notice and any other terms referred to or located on such Affiliated Sites. 


XI. Use of External Links 

Our online offers may contain links to third-party application and its affiliated services operated by providers that are not associated with us. After you click the link, we no longer have any influence over the collection, storage, use or processing of any data transmitted by clicking the link (such as the IP address or URL of the page that contains the link), as the behaviour of third parties is, by nature, beyond our control. Therefore, we are not responsible for the collection, storage, use, disclosure or other processing of data by such third parties. For further clarity, this Privacy Notice does not apply to any such third-party applications and its affiliated services; refer to the Privacy Notices or policies for such third-party applications and its affiliated services for information about how they collect, use, disclose and protect data. 


XII. How We Respond to Do Not Track Signals 

The “Do Not Track” (“DNT”) privacy preference is an option that may be made in some web browsers allowing you to opt-out of tracking by our website. At this time, global standard DNT technology is not yet finalized and not all browsers support DNT. We therefore do not recognize and/or respond to all DNT signals. We are currently in the process of recognizing the Global Privacy Control opt-out preference signal in a frictionless manner; however, at this time we do not. 


XIII. International Users 

The use of our online offers is targeted to users globally. In the U.S. and Canada our online offers are subject to U.S. and Canadian laws, as applicable, including, without limitation, those governing the privacy and security of your data. If you use our Services, you are transferring your data to us in the United States. By using our online offers or providing your data to us through our online offers you consent to the transfer of your data to the United States, and us handling of your data in accordance with applicable U.S. requirements and this Privacy Notice. Accordingly, your data may be accessible to courts, law enforcement and national authorities in the United States. You can obtain information about our policies and practices with respect to service providers (including affiliates) outside the country where you reside, or ask questions about the collection, use, disclosure or storage of data by such service providers, by contacting our Data Protection Officer or us as described below. In the EEA our online offers are subject to the GDPR and if applicable to national laws of the Member States of the European Union. 


XIV. Your Rights - US 

State specific privacy laws within the United States provide data subjects certain rights regarding the data that businesses collect and how the collected data is used. If you would like to exercise data subject right available to you, find the “Exercise your Rights” section below. Our privacy team will examine your request and respond to you as quickly as possible. 

We may still use any aggregated and de-identified Data that does not identify any individual and may also retain and use your data as necessary to comply with our legal obligations, resolve disputes, and enforce our Agreements. We maintain and use all de-identified information in de-identified form. We do not attempt to reidentify it except to ensure our de-identification processes are in compliance with applicable law. 

Dependent on the state of your residence, you may be provided the following rights: 

  • Right to know or confirm what data is collected 

  • Right to access your data 

  • Right to correct inaccurate data 

  • Right to delete data 

  • Right to know what data is sold or shared and to whom. 

  • Right to data portability 

  • Right of no retaliation following opt-out or exercise of other rights 

  • Right to appeal 

  • Right to non-discrimination 


XV. Your Rights – Canada 

Individuals located in Canada have certain rights pursuant to Canadian Privacy Laws. Subject to certain exceptions and limitations, and depending upon the jurisdiction where you reside, such rights may include: 

  • The right to withdraw your consent to the collection, use or disclosure of your data. 

  • The right to be informed of the existence, use, and disclosure of your data, and to be provided with an account of the use that has been made or is being made of this information as well as the third parties to which it has been disclosed (including a list of organizations to which your information may have disclosed). 

  • The right to challenge the accuracy and completeness of your data, and have it amended, updated, or rectified as appropriate. 

  • The right to acquire information about our policies and practices with respect to data, including: a description of the type of data held by us and a general account of its use; a copy of any brochures or other information that explain our policies, standards, or codes; and information about what data is shared with or accessible to our service providers or affiliates, including outside of Canada. 

  • The right to data portability. 

  • The right to challenge our compliance with the applicable Canadian Privacy Laws. 


XVI. Your rights - EU/ EEA 

To exercise your rights, please use the details provided in the section “Introduction & Controller”. In doing so, please ensure that an unambiguous identification of your person is possible. 

Right of access (Art. 15 GDPR): 
You have the right to obtain confirmation from us about whether your personal data is being processed, and, if this is the case, access to your personal data. 

Right to rectification (Art. 16 GDPR): 
You have the right to obtain the rectification of inaccurate personal data. 

Right to erasure (“right to be forgotten”) (Art. 17 GDPR): 
As far as statutory requirements are fulfilled, you have the right to obtain the completion or deletion of your data. This does not apply to data which is necessary for billing or accounting purposes, or which is subject to a statutory retention period. If access to such data is not required, however, its processing is restricted (see the following). 

Right to restriction of processing (Art. 18 GDPR): 
As far as statutory requirements are fulfilled you have the right to demand for restriction of the processing of your data. 

Right to data portability (Art. 20 GDPR): 
You are entitled to receive data that you have provided us in a structured, commonly used and machine-readable format or – if technically feasible – to demand that we transfer those data to a third party. 

Right to object (Art. 21 GDPR): 
Additionally, you may object to the processing of your personal data for direct marketing purposes at any time. Please take into account that due to organizational reasons, there might be an overlap between your objection and the usage of your data within the scope of a campaign which is already running. 

Objection to data processing based on the legal basis of “legitimate interest (Art.6 (1)(f) GDPR”: 
In addition, you have the right to object to the processing of your personal data at any time, insofar as this is based on “legitimate interest”. We will then terminate the processing of your data, unless we demonstrate compelling legitimate grounds according to legal requirements which override your rights. 

Withdrawal of consent (Art. 7 (3) GDPR): 
In case you consented to the processing of your data, you have the right to withdraw this consent at any time with effect for the future. The lawfulness of data processing prior to your withdrawal remains unchanged. 


XVII. How to Exercise Your Rights 

To exercise your rights, submit a verifiable consumer request or access request, as applicable, to us by either

  • Any information you can provide about your previous contact with us (e.g. contact point / touchpoint with us, screenshots, reference to a specific product/newsletter) 

Only you (or based on your state of residence, an authorized agent authorized by you to act on your behalf – see Section Authorized Agent below for more information) may make a verifiable consumer request or access request, as applicable related to your data. You may also make a verifiable consumer request on behalf of your minor child. Your verifiable consumer request or access request, as applicable, must: 

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Data or an authorized representative. 

  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. 

We cannot respond to your request or provide you with data if we cannot verify your identity or authority to make the request and confirm the data relates to you.  

We will only use data provided in a verifiable consumer request or access request, as applicable, to verify the requestor’s identity or authority to make the request. 


XVIII. Response Timing and Format 

We endeavour to respond to a verifiable consumer request or access request, as applicable, within forty-five (45) days of its receipt, or sooner where required by applicable law (including Canadian Privacy Laws). If we require more time (up 90 days in total), where permitted by applicable law, we will inform you of the reason and extension period in writing. Opt-out request will be honoured as soon as feasibly possible, but no later than 15 days from the date we receive the request. 

Any disclosures we provide in response to a verifiable consumer request will only cover the 12-month period preceding the verifiable consumer request's receipt, unless otherwise required by applicable law. The response we provide will also explain the reasons we cannot comply with a request, if applicable. 

For data portability requests, where applicable, we will select a format to provide your data that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance. 

We do not charge a fee to process or respond to your verifiable consumer request or access request, as applicable, unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request. 


XIX. Authorized Agent. 

When you submit your request through an authorized agent, we require that you: 

  1. Provide us a copy of your written permission for the authorized agent to submit the applicable request; and 

  1. Verify your own identity directly with us. 

The foregoing does not apply when you have provided your authorized agent with a power of attorney pursuant to California Probate Code sections 4000 to 4465; provided, that we may require a copy of such power of attorney before fulfilling any request. 


XX. Non-Discrimination 

We will not discriminate against you for exercising any of your rights. Unless permitted by applicable law, we will not: (a) deny you goods or services; (b) charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties; (c) provide you a different level or quality of goods or services; or (d) suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services. 


XXI. Filing a Complaint 

Regulatory authorities that oversee the privacy laws and regulations, including the Office of the Privacy Commissioner of Canada, advise individuals to file an objection or challenge with the relevant company before lodging a formal complaint with a regulatory authority. If you are dissatisfied with our response to an objection or challenge filed under Article XVII above, or you if wish to file a complaint with a regulatory authority first, you may do so as follows: 

Under PIPEDA: You may file a complaint with the Office of the Privacy Commissioner of Canada. Depending upon the province where you live, you may also (or instead) have the right to file a complaint with the applicable provincial privacy commissioner/regulator. 

Under U.S. State Laws: You may file a complaint with the applicable state Attorneys General Office or regulatory agency. 

Under the European Union’s General Data Protection Regulation (GDPR): 

You have the right to lodge a complaint with supervisory authority (Art. 77 (1) GDPR). You can appeal to the supervisory authority which is responsible for your place of residence or your state or to the supervisory authority responsible for Electro Voice Dynacord B.V.:

XXII. Changes to Privacy Notice 

Due to the constantly changing nature of our business, we reserve the right to change, update, revise and/or modify this Privacy Notice at any time at our sole discretion, and we will post any new or revised Privacy Notice here.
